PERSONAL INJURY

       Getting injured because of someone else's negligence is very traumatic for most people. Car wrecks can definitely have a lasting impact on your life.  Knowing what to do, and what not to do, after a car wreck is crucial to your safety and health as well as any potential case you may have. 

STEPS TO TAKE AFTER A CAR WRECK

Check for injuries and promptly call emergency services.

Get other drivers insurance information. All drivers, not just the vehicle that caused the crash.  Also, if possible get the names and phone numbers of any bystanders that witnessed the accident.

Take pictures of the crash site - all vehicles involved and any visible signs of damage, especially to your vehicle and the offending vehicle. The police report will contain relevant data such as measurements, skid marks, and the 'point of rest' (where a vehicle ends up after a collision) of each vehicle.

Of course, seeing a doctor as soon as possible takes priority over all of these steps.  Even if you do not think you are hurt that bad. Many injuries are not noticed right away, delayed symptoms are extremely common after a car crash. Seeing a doctor the day of or day after the accident is extremely important. Waiting a week or 2 to see a doctor damages your case.

Be sure to tell the doctor about all body parts that were injured. You and your doctor will understandably focus on body parts injured the most.  Sometimes, you may not be aware of less severe injuries until the doctors have the pain under control.  Do not leave any injury out no matter how minor or insignificant  you, or anyone else, may think it is.  Your complaints for every body part injured need to appear in your medical records.  If you never mention to your doctor that your left knee is hurting, then your left knee will not be discussed in your records and will not be considered an injury sustained in the car crash.

Write down what happened in your own words in a journal or notebook. Do this as soon after the accident as possible while it is still fresh in your mind.

Contact your own insurance company and report the accident, but other than your doctor, the police, and a personal injury lawyer, do NOT discuss the car crash with anyone else.

Document everything.  Write down names of witnesses and their contact information. Calendar the dates and times you spoke to other drivers or their insurance carriers or yours.

 When the insurance carrier for the other driver calls do NOT, under any circumstances, agree to give a recorded statement. If you have an attorney when they call, politely inform them and give them your attorney's contact information and end the call. Do not answer any questions or have any kind of conversation with the other driver's insurance carrier.  Your case's worth will be reduced if you speak to the carrier by yourself.  It does not matter how smart you are, talking to the insurance company by yourself is one of the worst things you can do for your claim.

Property owners, especially businesses, have a duty to maintain a safe premises. They are allowed a reasonable time to correct hazardous conditions, e.g. wet floors, but when an obvious unsafe condition goes unaddressed and a customer is injured because of it, the business is liable for damages.

I will submit a settlement demand to the defendant's insurance carrier along with a preliminary trial packet to demonstrate our willingness to proceed with trial.  I will negotiate a fair settlement.  And if they do not offer a fair amount, I will prepare your case for trial.

Until you speak to an experienced injury lawyer, you do not have the information required to make informed decisions. Especially if you've been talking to an insurance adjuster by yourself.  No matter how nice they are, adjusters are not on your side.
